These Terms of Use ("Terms") govern your use of borealispropulsion.com (the "Site"), operated by Borealis Propulsion Lab Inc., doing business as Borealis Manufacturing ("BPL," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site to learn about our services and to contact us or request a quote. In exchange, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information
- Upload files containing malware, or attempt to disrupt, overload, damage, or gain unauthorized access to the Site or its systems
- Copy, scrape, or harvest content or data from the Site except as permitted by law
- Infringe the intellectual property or other rights of BPL or any third party
2. Quotes and Inquiries
Any quote, estimate, lead time, capability, or pricing information we provide through or in response to the Site is for discussion purposes only. It is not a binding offer and does not create a contract. A binding agreement is formed only when you and BPL agree in writing to a specific scope, price, and terms for a project. We may decline any inquiry at our discretion.
3. Your Submissions
When you send us drawings, CAD files, specifications, photos, or other materials through the Site, you confirm that you have the right to share them and that doing so does not violate anyone else's rights. You keep ownership of your materials. You grant us permission to use them only as needed to review your request, prepare a quote, and provide the services you ask for. We do not claim ownership of your designs. Please do not send information you consider confidential without first contacting us to arrange appropriate handling.
4. Intellectual Property
The Site and its content, including text, images, graphics, logos, and the Borealis and Borealis Manufacturing names and marks, are owned by BPL or its licensors and are protected by applicable law. You may view and print pages for the sole purpose of evaluating our services. You may not otherwise reproduce, distribute, modify, or use them without our prior written permission.
5. No Warranty
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on the Site is complete, accurate, or current. Nothing on the Site is engineering, legal, or other professional advice.
6. Limitation of Liability
To the fullest extent permitted by law, BPL and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site. Nothing in these Terms limits liability that cannot be limited under applicable law. This section governs the Site only; any manufacturing services we provide are covered by their own separate written agreement.
7. Third-Party Links and Services
The Site relies on and may link to third-party services, for example our form provider, font provider, and mapping services. We are not responsible for the content, policies, or practices of third parties, and your use of those services is subject to their own terms.
8. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above shows when they last changed. Your continued use of the Site after changes are posted means you accept the updated Terms.
9. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws principles. You agree that any dispute relating to the Site or these Terms is subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
